Ex-PM moves amending law to rescind restriction in EAW application

Independent MP Jadranka Kosor said on Tuesday that restricting the application of the European Arrest Warrant (EAW) to crimes committed after August 2002 was wrong, and sent to parliament amendments to the law on judicial cooperation in criminal matters with European Union countries, moving that the restriction be rescinded.

"It's a mistake that can be easily corrected," Kosor told reporters.

She recalled that the EAW law was adopted in 2010, after the Constitution was changed to enable the extradition of Croatian citizens, and that the time restriction was adopted by the parliamentary majority, at the government's motion, in late June this year, "literally a few hours before we became the 28th EU member."

Kosor said her parliamentary group was moving to rescind the time restriction "to stop the disputes and unfortunate moments" that she said were increasing by the day. She hopes this to be the first item on the agenda at the beginning of parliament's autumn sitting so that "we can come out of the problems we are in as soon as possible."

"Croatia is going around in circles. It's not the worst thing or a tragedy to make a mistake. The tragedy occurs when ones doesn't want to admit the mistake or when one doesn't want to, can't or won't correct it," she said.

Kosor said Croatia would have to rescind the time restriction sooner or later "because it committed to such an EAW application in 2010 by adopting the law as well as by signing the EU accession treaty in December 2011."

The treaty was signed by Kosor as Croatia's then prime minister and by President Ivo Josipovic, who she is confident will support her motion.

"We guaranteed with our signatures to all EU member countries, which also signed it, that we accept all the commitments which we negotiated and which were entered into (the treaty). And the EAW is part of those commitments."

She described as serious the warnings from the European Commission about possible sanctions against Croatia because of the restriction in the application of the EAW.

Kosor said she expected the entire opposition to support her motion, but also the ruling coalition parties which had spoken against the restriction, including Foreign Minister Vesna Pusic.
