Temporary ban on alienation of Dajla parish real estate

The Office of the Chief State Prosecutor (DORH) on Wednesday filed a motion with the Municipal Court in the northern Adriatic town of Buje to "secure nonpecuniary claims by the Republic of Croatia by imposing a temporary ban on the alienation of and laying of claims on real estate previously restored to the Dajla parish," announcing that it would take "appropriate legal measures" to ensure that the ownership of the real estate in question was restored to the state.

In a statement published on its web site, DORH said that the motion was filed by the Buje Municipal Prosecutor's Office after the Justice Ministry annulled decisions of the Istria County office for property affairs (made in the period from 1997 to 2002) under which the Dajla parish, as the legal successor in the church and civil areas of the Benedictine monastery in Dajla, was given back ownership of the real estate.

Since the ministry decision also annulled all legal effects arising from the previous decisions, the Buje Municipal Prosecutor's Office filed the said motion in order to protect the property interests of the Republic of Croatia, DORH said.

DORH also said that it would take appropriate legal steps to restore the ownership of the said real estate to the Republic of Croatia.
