Justice Ministry rejects to serve Serbian war crimes indictments

Serbia's judiciary has once again sent Croatia's judiciary indictments against Vladimir Seks, Ivan Vekic and Tomislav Mercep for war crimes, however, the Justice Ministry has rejected to enforce them and sent them back to Serbia, unofficial sources at the Croatian Justice Ministry reported on Sunday.

A memo from the Serbian Justice Ministry, with requests by a Belgrade High Court to serve indictments filed by the prosecution of the former Yugoslav army on 10 August 1992, arrived in Croatia in late November.

The ministry has rejected to serve the indictments based on a 1997 bilateral agreement between the two countries which does not allow acting on indictments filed by former military prosecutors.

The indictments were originally sent to Croatia in August 2011, when Serbia's authorities requested they be served to Seks, Vekic, Mercep and Branimir Glavas, and the Croatian Justice Ministry sent them to the relevant courts.

The indictment for Glavas was not sent in this recent case and some media speculate it was sent to the Justice Ministry in Bosnia and Herzegovina, where Glavas is serving a prison sentence for war crimes.
