Court did not receive Brodarac's medical records

The president of the Osijek County Court, Ninoslav Ljubojevic, told reporters on Thursday that to his knowledge the court was not provided with medical records of late general Djuro Brodarac at the time the decision on detention against him was made.

Ljubojevic said he examined the file, stressing that no medical records were included. He said that if the suspect has health problems the prison administration must be informed about it.

Reiterating that no medical records were enclosed, Ljubojevic said that the judge who visited and talked to Brodarac in the Osijek prison said Brodarac told him he had no objections to the prison system.

The lawyer for Brodarac, Petar Sale, accused the state authorities and the penitentiary system for the death of his client. Sale said that it was known that his client was ill as all medical records were enclosed. He stressed that Brodarac should have been released pending trial.

Commenting on Ljubojevic's claims that lawyers had not submitted Brodarac's medical records, Sale said he was surprised that such a statement came from the county court president.

"I wonder how come they allowed him then to take so many pills and I wonder if the prison doctor examined him," Sale said.

According to preliminary autopsy results, retired general Djuro Brodarac died of sepsis and further postmortem examination will establish what caused sepsis.

Brodarac, who was kept in investigative custody in Osijek and transferred to a local hospital when he fell sick on 12 July, passed away in the hospital's intensive care unit on Wednesday morning.

Ljubojevic told the press the exact cause of death will be known upon the completion of the analysis of all autopsy results, most probably not before August.
